mother's murder. eyewitness news at 4:00 starts now. motor sport in mourning. an indy car driver is killed during a race. new clues in this deadly high- speed pileup. high everybody, i'm mary bubala. kyle is off today. people are talking about that he died do whatting he loved. one day after a fiery crash in an indy car race killing a driver, people are questioning the safety of the las vegas track. randall pinkston reports from new york. >> reporter: dan wheldon's car, number 77, went airborne and slammed into a fence as he was trying to avoid a 15-car pileup

just minutes after the race started. emergency crews rushed the 33- year-old british driver to a local hospital where he later died. three other drivers were injured. speeds at the indy 300 in las vegas exceed 220 miles per hour. >> you're able to sustain that speed and build momentum and so you have then the fact that they run three or four wide and the domino affect when the track got blocked. >> reporter: drivers were concerned about high speed at the las vegas motor speedway. they said we all had a bad feeling about this particular, in particular because of the high banking and how easy it was to go flat. we knew it could happen but it's just really sad. >> reporter: fellow racers say wheldon will be missed. >> everybody in the indy car series considered him a friend. you saw the reaction. he's one of those special, special people. >> reporter: news of wheldon's death spread throughout the racing community. he won the indianapolis 500 two

times. fans created a memorial outside of the gate. >> he was a great ambassador of the sport and he was one of the nicest guys i've ever met. >> the guy is just genuinely down to earth all of the time. >> reporter: he leaves behind a wife and two small children. randall pinkston, cbs news. >> and this is the first indy car death in five years. missing maryland woman. an aruba judge decides if gary gee order and youo can be released on bail in the robyn gardner case. vic is in the news room. >> reporter: for a second time the judge denies the request to release gary giordano. he's the suspect in the disappearance of robyn gardner. he was ordered to jail after she disappeared. his attorney said there is no proof he did anything wrong and she disappeared while they were snorkeling. his lawyer will try again at the end of the month when the 60 day order to hold him

expires. many believe gardner is dead and the victim of foul play. the stepfather of a missing boy waives his rights and will return to maryland to face murder charges. he's charged with killing jane mcquain in her germantown home. but the search for her 11-year- old son continues. >> we are focused right now to locate william mcquain. >> reporter: police are desperate to find the 11-year- old from maryland who has been missing for almost a week. and they spent eight hours yesterday searching two parks in northern montgomery county for william mcquain. those searches turned up nothing. >> the hope is that he's still alive. however, we are using teams and people experienceds when the person is deceased. >> you don't really think something like that will hit in your home town. i hope they find him and i hope

they found him alive. >> reporter: police found mcquain's mother dead in her home in germantown. they located her estranged husband in north carolina and he's charged with killing her. >> i saw him get arrested. >> reporter: he has not provided information on where the little boy may be. he has a violent history and mcquain's mother has told friends she was scared of him. young william's friends are keeping faith, hoping he'll be found safe and found alive. >> he's probably lost and scared right now because he has no one or nowhere to go. no food or anything. >> reporter: the search yesterday included dogs, horses and almost 100 police officers and volunteers. police searched again today for mcquain. mike hellgren, wjz eyewitness news. a search warrant of the

of former ravens owner art model, funeral services are held at the basilica downtown. past and present friends of the raven organization paid their respects. she and her husband gave generously to many organizations, including the opera house which is now named for the model. pat model was 80 years old. turning to the weather, it is a bright, sunny monday afternoon. here is a live look outside at pleasant, fall-like conditions. we have traffic and weather today. here is bernadette. >> mary, it is gorgeous out there this afternoon. we had the clouds during the morning and they have since left. and take a look at first warning doppler radar. not a lot going on. it is 71 degrees outside. there is a storm off to the west and one down to the south. two of them are going to converge and move our way over the next 24 hours. and that is going to bring about a change. and we'll have more on that

>> reporter: president obama is shaking hands and talking up his jobs plan as his bus winds through north carolina. he picked up lunch and got face time with voters at countryside barbecue in marion. the president kicked off his three-day road trip at ashton regional airport. he called out republican lawmakers who blocked his $447 billion jobs bill in the senate last week. >> we're going to give them another chance to do their job by looking after your jobs. >> reporter: now the president wants congress to pass his jobs package in parts, starting with $35 billion for states to prevent teacher layoffs. president obama's bus tour will make several more stops in north carolina, then virginia. two battleground states he won in 2008 that are crucial to his re-election. to win there again, the president will need to hold on to past supporters like leonard crook. he said a weak economy will hurt president obama's chances in north carolina.

free concert tickets are being sold for hundreds of dollars online. the band sugarland is set to perform a preconcert in indianapolis two months after the stage collapsed during their show that killed 7 people. free tickets to the general public were limited to four per household but somehow people got around the rule reason aselling free tickets on the internet. donations for collapse victims will be collected at the show. a six-alarm fire explosion injured over a dozen people, destroying 40 apartments in boston. crews rescued 15 people in the fire, including a 6-year-old boy who was dropped from the

third floor into the arms of a firefighter. investigators say a man confessed that he started the fire by tampering with a gas line. 12 people are recovering in the hospital and a shelter is set up for displaced residents. in tonight's health watch, the american academy of pediatrics is out with new guidelines for diagnosing and treating adhd in kids as young as 4. sandra hughes reports for wjz. it's the first time the group has recommended treatment for children that young. >> take a nice big breath for me. >> reporter: 10-year-old michael takes medication for his adhd. doctors diagnosed him with attention deficit hyperactivity disorder when he was 5 years old. >> he was having trouble focusing and any sound he would hear, he would be distracted. >> reporter: hyperactivity, lack of impulse control and

lack of attention are classic signs of adhd but treating preschoolers with those symptoms used to be tricky because there were no guidelines until now. the american academy of pediatrics released information on children as young as 4. more than 5 million children ages 4- 17 have been diagnosed with adhd at some point in their lives. almost 3 million take medication for the disorder. under the new guidelines, the first treatment should be behavior therapy. if that doesn't work and the sim tolls are pretty bad, doctors should consider medication. >> the hope is that with early identification and behavioral inventions as a first line of treatment, that children can function better, be better accepted by their peers, do better in a classroom setting when they enter grade school. >> reporter: michael struggled during kindergarten and had to repeat the grade. his mother wished he would have

gotten help sooner. >> at 4 had he been diagnosed with adhd, i could have saved myself and my son a lot of grief. >> reporter: now in 4th grade he's doing well in school. sandra hughes, cbs news, los angeles. >> previous guidelines including 6-12-year-olds, the new ones go from 4 to 18. a rough start to the week on wall street. christofferrous. after two years of planning, andrea gee explains they are ready to tutor young students living with cancer. >> reporter: the cool kids campaign is set to open the door to learning. about 600 children are diagnosed with cancer in maryland and many of them struggle in school. so the cool kids campaign offers free one-on-one tutoring. >> they really do fall behind. the chemo causes a lot of cognitive delays so even when they are in school it's much harder to process the information. >> reporter: with the help of nearly $100,000 in donations, the new location already offered cancer-related social programs, like teen movie nights. the organization started six years ago providing care packages to sick children nationwide. quality tutoring is the next step. >> we have about two or three kids signed up, getting ready to come in. the volunteer aspect is tremendous. >> reporter: dozens of tutors

we've had two beautiful days. absolutely incredible. >> and today was beautiful too. >> and we rounded out the week going into that. and there is a front that went through overnight and you may have seen some of the clouds this morning. get out of here already. it's a beautiful afternoon. just picture perfect. and because of the sunshine out there, we topped out so far at 71 degrees. could still go up a couple of degrees over the next few hours before we start to drop overnight. temperatures overnight from last night stayed in the 50s because of that front going through. but, look, as i spoke, we're up to 72. so we'll have to update the temperature now. so a nice, warm afternoon across the state at this point. the winds turned around to the west with the front going through and they're a little bit breezy at times. those start to come down tonight as we get our break before yet another front comes our way. and as it does, it is coming in two different parts. this one is in the west and this one down from the south. the western one will draw up the southern moisture and once again it's tropical moisture and move it in our direction.

so tomorrow we start out with sunshine. clouds start to increase during the day. and then tomorrow night the chance for rain around here. that will pick up by wednesday. we could even get heavy rounds of rain as all of that converges over the mid- atlantic. so it comes together like this. we get rid of one front, breezy and dying over overnight. here comes the next one and all of the rain tuesday night into wednesday. now by thursday it's already gone. but our weather pattern is still going to be pretty unsettled with that moving through. so a couple of showers possible on thursday. and behind that storm, much cooler air. so on the, bay temperature 66 and the sunset at 6:24 right now. and we're going down to 52 degrees. a quiet night out there. mild considering our averages. then tomorrow we're back up above average. the average right now is 66 degrees. so this stretch continues. sunshine will give way to increasing clouds and then as we head to the evening hours, we'll see the clouds take over

1,000 palestinian inmates in exchange for one captured israeli soldier. >> reporter: palestinian prisoners arrived as an israeli jail as the government prepares to set the inmates free. most israelis backed the release of 1,000 palestinians in exchange for one captured israeli soldier. but a group of opponents marched through the streets of jerusalem carrying white flags. they say israel is surrendering to hamas militants who have held the man captive in gaza for more than five years. >> it's a surrender to terrorism. >> reporter: some of the prisoners are palestinian militants responsible for deadly attacks against israeli. one man set to be freed drove a suicide bomber through a crowded pizzeria in 2001. the bomber killed 15 people, including arnold ross' daughter. >> it is beyond my comprehension that the government of israel, which has them behind bars, would ever

contemplate allowing them out again. >> reporter: several families are filing court appeals to stop the exchange. something that is unlikely to happen. palestinians are celebrating the pending release. printing banners and building a stage to mark the event. she said thank god the agreement was fulfilled. palestinians consider the inmates heroes in their fight for a palestinian state. tina krause, wjz eyewitness news. >> israel will begin releasing the prisoners over after shaled arrives. a work working in the south pole and suffered an apparent stroke. her employer, the national science foundation rejected a request for a rescue plane, blaming a major snowstorm. she had to wait 7 weeks for an evacuation. doctors say the woman's stroke- like symptoms may be the result

of a brain tumor. the woman is still having trouble with speech and vision and is scheduled to see a specialist tomorrow. a spokesperson for the national science foundation spoke about the long wait for a rescue plane saying they must consider the patients safety and the safety of the reese coup crew. philadelphia police are calling it despicable. three people behind bars charged with keeping several mentally challenged people chained up in a boiler room. here is the story. >> reporter: inside this apartment building in the 4700 block of long shore avenue in tackony, police found four mentally challenge adults, a 29- year-old female and three males, 31, 35 and 41. police say they were emaciated, bruises and hild captive in a boiler room the size of a bedroom. >> the 41-year-old male was chained to the boiler. >> quite simply, this case makes you shake your head.

it's despicable. >> reporter: the handyman for the apartments found those living in deplorable conditions. so far three people were arrested. a 51-year-old man from texas, a 48-year-old man from philadelphia, and a woman who police say is the ringleader. >> what we believe is that the female who is a 50-year-old female, we're not giving the name out yet because she hasn't been completely i.d.ed was taking in mentally challenged adults that had learning and physical disabilities and we believe she was using their ssi checks and taking their money. >> we do know it's a horrible crime. and we're just glad that we found these people when we did. because they deserve a lot better than this. >> two of the suspects are being held on half a million dollars bail even. the suspected ringleader has yet to be arraigned. today thousands of people occupying the new york

financial district, the occupy wall street movement has gone global. people demonstrating across the u.s., europe and asia. in new york alone supports have raised $300,000 for their cause. the nation's capitol is back looking for damage from the earthquake. as we speak, a team of engineers is rappeling the national cathedral and the team is carefully inspecting the historic church for any more damage. and they have found plenty. three of the four stone pinnacles on the central tower were damaged during the quake. last week stone masons removed to tons of damaged stone work. the cathedral has been closed since the earthquake and is scheduled to reopen on november 12th. well the clear skies are a great way to start the workweek. here is a live look outside at nearly perfect autumn conditions. we have weather and traffic together. bob is here with first warning weather. bob? >> it turned out to be a

gorgeous afternoon. it cleared out quickly. around here it is quiet. but down to the south, south of the miami area, a lot of rain between key west and cuba. that's a tropical system moving to the north. this system to the west is moving in our general direction so we have rain coming this way and this way, which means we're looking for a very wet wednesday. before that time, it will be just perfect. after that time, things will get chilly and windy. we'll talk about that in a few minutes. let's check in on the roads with sharon at wjz traffic control. >> good afternoon, everyone. well some good news. we have improvement on that top side of the beltway accident. we had all lanes blocked on the inner loop at hartford road. at this point only the right lane blocked. still a pretty big jam behind it. also watch for a new accident in windsor mill that went on lord baltimore drive at wind sore. crash in jopa still on route 7 at jopa road.

resume. the doctor conrad murray is accused in the michael jackson death overdose. attorneys for 19-year-old darryn robbie are asking the state to turn over his former roommate's suicide note. tiler clemeny took his own life after robbie spied on him with a camera during a sexual encounter. a judge will rule this week. the mother on a missing toddler comes clear with what she was doing while her child disappeared. >> reporter: in a recent interview, bradley admits she was drinking heavily and drunk before mer 11 mold daughter went missing. surveillance cameras caught her buying a box of wine hours before her 11-month-old daughter was missing from her bedroom. she put her child to bed and fell asleep. her husband found the bed empty the next morning. several search parties have

turned up no clues about the child's whereabouts. >> police questioned bradley but they are not calling her a suspect. the fast and furious gun walking case is back in the headlines. this time the question about a murder of a u.s. border agent. we have the latest in washington. >> reporter: the murder is that of border patrol agent brian terry, gunned down near the border last december and at least two assault rifles from atf fast and furious case were found at the scene. that focus blamed the atf operation that monitored suspects who traffic the weapons instead of arresting them and seizing the guns. but ten months after the murder, there are questions about how many weapons the fbi recovered at the scene and other key details. on sunday's face the nation, republican darrell ica told bob schaeferer there is reason to ask whether there is a third missing weapon. >> when agents who were at brian terry's funeral made statements to his mother indicating that there were three weapons, then you look and say well, was there a third

weapon at the scene, were there additional people who escaped with weapons? >> reporter: also a ballistic report mentions two rifles and it could not be determined if one of them filed the bullet that killed terry. and an sks rifle, the leading agent is speaking to a gun dealer who cooperated in selling weapons to suspects. >> there are three weapons. >> and you sold all three? >> that is correct. >> two of them came from the store. >> i understand that, yes. >> and there is an sks that came from texas or something. >> no. >> they have twice rejected freedom of information requests for releasing details saying it would jeopardize the case. a woman is carried out of a burning building. a fire ripped through this home

the reality is no laughing matter. on friday the director of starbucks said climate change is threatening the world's coffee supply saying what we are really seeing as a company as we look 10, 20, 30 years down the road, if conditions continue as they are, is a risk to our supply chain, which is the coffee bean. >> coffee likes a narrow range of temperature and one of the hallmarks of climate change will be increased extreme in temperatures. >> reporter: scientists say climate change will cause heavier rains, longer periods of drought and higher rates of infect infestation where coffee is grown. factors that could have a devastating affect on future coffee production. >> those of us who enjoy a morning cup of coffee, we may not always realize that future climate geared to increased temperatures, extreme precipitation really could in some ways put that at risk. >> reporter: in cared carbon emissions have been linked to global climate change. so for coffee lovers, the idea of waking up without the

going to combine. one of them will pass through the ohio valley, the other one along the east coast. so we'll be maybe in between. it looks like a very windy and wet wednesday before things calm down. this one will move quickly and this one may hang out a little bit, but to the north another air mass will filter in. so after the rain on wednesday, it gets chilly and breezy. it will feel like fall by the middle or end of this week. so that low pressure developing out to the west. the other one coming up from the south. you can see the rain on the model on late tuesday night and most of the day on wednesday before the chilly and somewhat drier air comes in. there may be a left over shower on thursday but cooler. bay temperature at 66. southeast winds at 5-10. that will be picking up on wednesday. tonight clear and partly cloudy, a nice night at 52. tomorrow sunshine and some clouds with increasing clouds by evening. maybe some rain by late, late
